While there's no easy, immediate way to tell, the first place to start is where you purchased it. Did you purchase it directly from Apple or from an Apple Authorized Reseller? If so, then it would be a legit Apple product.

Did you purchase it from a 3rd party source like Facebook Marketplace, or Ebay for example? If so, then it's possible it may not be a legit Apple product since anyone can sell anything through places like that.
If the mouse is not working properly, your best option would be to take it to an Apple Store or Apple Authorized Service Provider location. A technician there will be able to physically inspect it to determine if it's legit or not, and also complete any repairs you need if it is in fact a genuine Apple product.
