To sign out, you need to follow these steps:

Sign out of iCloud on your iPhone, iPad, iPod touch, Apple TV, or Mac

Are you seeing a message to login when you set up the iPhone?

That would instead be activation lock:

Activation Lock for iPhone, iPad, and iPod touch

Only the previous owner can remove the activation lock.
