apple TV remote LED light no longer lights/flashes - does this means the IR doesn't work? The remote still works with my apple tv but it doesn't control volume or power on my actual tv.

The LED of the remote shines in IR EM frequencies, not visible to the human eye. That the remote still does navigation on the Apple TV box, means that Bluetooth for such signals still works. Volume control is separate from that, and supposed to work through IR to the TV (for its built-in speakers) or external audio system directly. The TV or audio system would need an unobstructed IR receptor for such signals.
Have you tried restarting just the remote, using the button combination, as indicated in:

Else check the settings for the remote: Settings﹥Remotes and Devices﹥Volume Control﹥…
‘Auto’ is supposed to self-detect what is likely best to use. If that doesn’t work for you, then try one of the other options.
‘TV via IR’ would seem like a good solution for you.
‘Off’ would disable volume control through the Siri Remote.
Choose ‘Learn New Device’, if needed, to teach the Siri Remote what non-standard IR signals your TV or audio system might want instead for volume control, by checking through another device remote. After configuring that, the new settings may show as ‘Custom’ in the list.
If you need more assistance, then please find your exact model number for the TV.
