my new iphone12 is locked to the previous owner

I'm stuck, the apple id is deleted but my new iphone 12 is locked to the previous owner (my brother and I already went through the procedures to delete his account)

We even try to put the phone in DFU mode and restore that way but the issue still persists we can't get to the screen to enter the Apple ID. Has anyone face that before and how did you solve it?
