Accessing a deceased person's account

My husband died suddenly and unexpectedly. I don't know the password for any of his devices. I desperately want to access his icloud account so that I can get the photos I took of him and our children on his last day.

I have taken the devices to an Apple store and they were unable to help. They directed me to Apple Canada. It seems in spite of having a death certificate and his will (that names me as his executor) they also want a court order.

I phoned the lawyer who prepared our wills and they have never heard of this - and said that a death certificate and his will should be enough. (Interestingly, that is enough for the banks, but not Apple). The lawyers weren't able to offer any further direction.

Can someone please tell me how I can go about getting a court order in order to access his account (most importantly, his photos?) What type of lawyer would prepare the documentation for court? What is the process and how can I move forward with this? Thank you in advance for your help - this has been the most difficult time in my life and I'll be so grateful for any advice or guidance.

interests & security are involved; as it varies by jurisdiction.


So that may be a place to seek more help, direct from Apple.

Or ask your local regional court about how to open probate

court case in this matter; I've done it, at a State level.


Those of us who reply here, in support discussions pages, do

By court-order it means the legal procedure effectively “activating” your executorship.


Simply presenting the death cert and will is generally insufficient for most settlement matters w/o without a judicial “endorsement.”


Generally, the validity of the will must be adjudicated before the estate can be formally settled.


In my own executorship in the U.S. I received a Letters Testamentary from the court legally empowering me to act on behalf of the estate.
