airpod maxes not turning on + randomly connecting to other devices

I've had my airpods max for a year now, and I've had the issue of the headphones not responding to any buttons at all until it is manually resetted a couple of times. It would just be complete silence and if it somehow connects to a phone (but the buttons still wont work), the sound that plays through is extremely buggy and laggy.

For the past few weeks, I have realised that even if I have my headphones off of my head, it will still try to connect to my devices, and other people's devices that has never once been connected to??? The banner of my headphones just pop up on everyone's phones who are around me and I am sure this is a system issue because I've tried everything to prevent it.
