Read the support article About firmware updates for AirPods - Apple Support for tips about ensuring your Airpods can receive any updates. Try leaving them plugged in overnight near your iPhone.
If you still have questions or problems:, refer to this document for ways to contact Apple --> Choose your country or region - Official Apple Support Select your country (also look for "other" regions), then a product. If you don't see one that handles your issue then keep experimenting with selections until you reach one that gets you a chat session or a telephone call and get the representative to redirect you.

I would not automatically assume that your Airpods are fake if they are not updating, but fake Airpods will not receive updates from Apple. Enter the serial number in this link --> Check Your Service and Support Coverage - Apple Support Does it find them? If yes then at least the serial number is real, but fake copies might have real serial numbers that will, of course, be reported as valid. If you take them to Apple they can tell the difference. The bottom line is the only real way to be sure Airpods are not fake is to only buy them from Apple or an Apple Authorized retailer. --> Find Locations
