If you purchased them of outside of Apple you always run the risk (high) that they are fakes.

By purchasing them from Apple or an Authorized Reseller AND breaking Apple’s unique, tamper-evident seals yourself.
The scads of “AirPods” available online are almost all counterfeits.
Some are quite “convincing” cosmetically-speaking; they might even have “legit” serial numbers cloned from a genuine pair.
