Why are my 'crackling' AirPods Pro not replaced by Apple?

HISTORY: I purchased my original AirPods Pro in Nov 2019 with AppleCare. Eleven months later, on Oct 06 2020, I had the left AirPod replaced due to documented sound issues. The right AirPod was also replaced free in Feb 2021. Apple later identified issues with AirPods produced before Oct 2020 being eligible for free replacement with 3 years of purchase. My 'replaced' AirPod began exhibiting issues so I followed advise to reset my AirPods and the problem persisted. Hearing of the extended warranty, I sought Apple Support at the Store's Genius Bar in Aug 2023. After discussion with Apple staff and the manager, I was told that my problematic AirPod was not eligible for replacement because its serial number is outside those that Apple identified for replacement (serial no: H19D8P2C0C6K model: A2084).


SOLUTION: Because the identical symptoms exhibited by my AirPod Pro are identical to those of those identified for replacement and the AirPod was produced before Oct 2020, Apple should replace it as part of their service commitment.
