What to do if your airpod is being stolen, can I disable it so the thief is unable to use it?
the stolen airpod was already marked as lost but now i am able to see from Find My app that the person who stole it is using the airpods?

About AirPods and Find My:
If Find My was enabled with these, then note that the local shown is based off of the last time the device they were connected to that itself was connected to the internet. This is because AirPods are not assigned their own IP Address. So, are you aware of anyone who has access to your devices? If so, and that device had these wired to it, then you would know which device these were unpaired from, perohs singling out the person who sole them.
If Find My is Not Working, here are Some Thoughts:
A. Backtrack your Locations:
Do it the olde fashioned way and backtrack your locations. For instance, if you were at a retail store, then stop in, asking the store manger if it was placed aside.
B. Lost-&-Found:
Chick with the Lost & Found department of the facility you were in, seeing if it has been handed over.
C. Contact Local Authorities:
See if the community police, or local security guards at the front door, can across it.
D. Use Craigslist:
Put a post on Craigslist, seeing if they have been found.
