Unless your heirs have the ability to “clear” the activation lock, the phone will remain unusable by anyone.

Note that while a Legacy Contact will have access to the decedent’s AppleID AND conditional access to any data stored-in / sync’d-to iCloud …
… AND the device’s Activation Lock is “released” allowing the device to be repurposed …
… they STILL will not have access to your on-phone data w/o knowing the passcode.
Without the device’s passcode, all they WILL be able to do is “Wipe and Reuse” … which are your apparent desires.
