I need to update my ipod to the ios 10 but it wont let me in settings
I click on software update and it says it is up to date with the iOS 9.3.5

If you're referring to a fifth generation model, it isn't capable of 10 or above. Otherwise, open Settings, remove the beta profile, restart the unit, and check again.
