ANC with airpod pros 2 is worse then my first gen

The anc lets a lot of noise through, more then my first gen, and the left ear one feels like someone is playing with the anc strength slider, makes it unusable, sounds will be let through more in the left then the right... I've contacted support and tried all the trouble shooting options with no luck (Everything is up to date, tried resetting the phone and airpods, passed the fit test, they have a good seal)... Just set them into repair and they said they couldn't replicate the issue and are sending them back with no fix, I wasted $300 as the anc was the main reason I bought them... Really not impressed right now, anyone have any ideas as to what I can do??
