You should not uninstall/delete Image Capture. (FWIW it may not even be possible to do so.)
Image Capture is one of the embedded apps on all Macs. And it's tiny (<2.5MB) so it's not taking up any meaningful disk space.

If you just meant remove the icon from your Dock, just click & drag the icon out of the Dock, hold it momentarily on your Desktop and then release your mouse. That will remove it from your Dock but does not uninstall the Image Capture app.
Regarding the HP software, since you updated your Mac you may need to uninstall & then reinstall the HP driver/app for your printer/scanner. If you do this, do a shutdown & restart after uninstalling the HP software. After you restart, then do the new install. Make sure you download & install the HP software that is compatible with your new version of macOS.
Is there a way to by-pass it? I have an HP printer/scanner which I have had no trouble using for years. In November I did the recommended software update and all of a sudden the Image Capture icon appears in my dock and when I try to scan a document like I did prior to the November software update I cannot scan.
