Setting up a Apple Watch with my iPhone
cant set up as some one else’s Apple ID has been used and resetting the factory settings does not undo the lock on this Apple Watch. Bought this watch new but packaging had been opened.

Did you buy it from Apple? If not take it back to the retailer you purchased from. They appear to have given you a used watch sold as new that had not been properly restored (and shouldn’t have been sold as new but as open box).
