Except for possible use as a paperweight, the phone is going to be totally useless to you unless you can somehow find the original owner and convince them to give you the Apple ID and Apple ID password that was used to set up the phone.
Without being able to get a refund or have the original owner remove the device from their account, the iPhone will never be able to be used by you. Apple will not be able to remove that for you. The device could have just been improperly reset before selling or it could be a stolen device. That is just one of the problems you could experience when buying a used device.
