Notes isn’t letting me do a checklist

Okay so i’m at a total loss, i’ve been trying to make a checklist for like 30 minutes and nothing has worked. My icloud is connected to notes, i’ve checked setting and even restarted my phone. After the ios 17.2.1 update I no longer have the option. WHAT IS GOING ON?! please someone help 🙏

Where were the Notes? See the pic below. You will get your answer

The various options that you are referring ("the second text menue") to will exist only if your Notes are on iCloud or the "On My Phone" Folder.
