Unlocking phone reported lost

Partner had an iphone which he lost on a train and eventually got a new one via insurance. In the meantime the service provider locked the phone as a security measure.

The phone eventually turned up but is locked and although I'd like to take it over as it's a newer model than mine I can't, do I have to contact the service provider to do this as they locked it in the first place?

Since the phone was replaced, I don't believe you have the right to use the phone. That would kind of be insurance fraud. You'll have to contact the carrier, but they will likely ask you to hand the phone over to them as you got an insurance replacement.
