It's quite disappointing to find "after the fact" that the Oxygen app on the newest apple watch is not available due to a court ruling. I used it daily, and it caught me off guard after I purchased and tried to use the O2 app- and found it unavailable.

Yep, due to court action it had to be removed from the US versions on the Series 9 and Ultra 2 watches. There has been no movement in the case that has changed this ruling and it is not included as a feature in the Series 10 watch. You do have 14 days to return your watch for a full refund.
