Restoring deleted photos
i got a new phone and before giving the old phone away I deleted all the phi from the old phone, but it deleted them from the new phone as well

Check if they happen to be in the Recently Deleted folder in iCloud. If you removed them from the Recently Deleted folder on the device, then they are gone.
This is the proper way to reset your device before giving it way. You should not delete the photos off the phone manually.
