Are replacement Apple Pencils (Second Gen) brand new?

I just ordered a brand new but defective (it pairs to my iPad but does not recognize my pencil swipes at all) Apple Pencil 2 from an authorized online reseller. I went to a different authorized retail reseller with service center. They said they are willing to provide me with a replacement unit after confirming that my pencil is indeed defective but as of writing this, they are still processing to procure my replacement unit overseas. So it may take a while for it to arrive. So my question is: Are REPLACEMENT Apple Pencil 2’s brand new or used/refurbished? I’m wary of getting a replacement unit that’s not in the same “time” condition as my zero day old pencil.

Most likely they would be refurbished, Apple states replacements can be either new or refurbished at their discretion and depending on availability, but if it was refurbished by Apple, it would be indistinguishable from a new one.

Apple's refurbished items go through a rigorous testing process to ensure correct and full functionality a kin to brand new units.

With that said, Apple is no longer making the Second Generation Apple Pencil, so a new one would at this time be hard to procure.

I’m in Southeast Asia. I still see a lot of Pencil 2’s in the market here with limited availability of the Pencil Pro. So perhaps procuring the replacement Pencil 2 could vary based on region. I’ll just let the service center staff work on my replacement pencil 2. Thanks for the clarification on replacement condition.
