You've likely been scammed and no one, including Apple can help you. As others have already suggested, try to get your money back, but if you can't, you've bought us useless brick you can never use unless you can reach the owner who locked the phone and they agree to remove it from their account. Which in all honesty, you likely have more chances of winning the lottery than finding them. Apple won't help you find them at all. If you can't get your money back, chalk this up to a bad buying decision and recycle the phone responsibly.

You should always be cautious about purchasing a used device from an unknown seller. Users have found after purchasing a device, the seller is no longer available and it is always possible the device could be stolen. The Activation Lock that you are seeing is working exactly like it is supposed to and cannot be bypassed. The seller needs to factory reset the device before it is sold and that is not possible with a stolen device.

You can't. Return it and get your money back if you can. If you can't recycle it. It's useless.
Sorry, but no solution unless you can get a hold of the person who can provide their Apple ID and Password to unlock the phone.
The phone is useless otherwise.
