Is this “Apple Pencil” fake?

I bought this Apple Pencil 2nd gen off of eBay as a Christmas gift for someone, and it arrived in the mail yesterday. The eBay seller had 100% positive feedback, so I felt pretty confident that it would be a genuine Apple Pencil like they claimed. However, when I attached it to my iPad Air 4th gen, it showed the Apple Pencil animation but did not show a battery percentage. It just sat there and pulsed for about 10 seconds. It does not show up in the About section of settings either. I also noticed it has this cap at the top of the pen that I can pull off and see the battery. Is this genuine?

Apple no longer sells the Apple Pencil 2 so the issue may not be that it is a fake, but that it has never been charged and the battery is now incapable of charging. This is a known issue with rechargeable lithium batteries.
