Assuming that it’s not your Apple Account displayed on the Activation Lock screen …
… ONLY the prior “locking” owner can release the lock by following these instructions:
How to remove Activation Lock - Apple Support
If you can’t obtain the cooperation of that owner, the phone will remain unusable by you.
