iPhone 13 has Face ID only, and not Touch ID.

The Face ID 3D scanner isn’t fooled by photos. The scanner can potentially find your face in the background if the scanner is active, and if somebody is deliberately scanning your face while waving your phone around as part of their “using a photo” claim), and scanning your face will unlock. As it should.

If people are getting into your iPhone, change your iPhone passcode. This is more likely than Face ID getting fooled by a photo.

You will want to re-secure your Apple Account and all of your other passwords, and also run Safety Check, if your passcode has been compromised.
