If you have no Mac or PC or iCloud backups of the iPod touch, and didn’t use iCloud for the data, then the data is gone.

No.

It depends on how old: 5th gen or later

And what iOS it’s on: iOS 8.1 or later

if both of these are true about your device then it is a lot more likely that you can but not 100%
