Access to iPhone backup in iCloud older than 180 days…

My phone was stolen with my car in June. It was ultimately recovered and kept in police evidence storage until this week. I was told to come pick-up the phone yesterday only to discover they had lost it. I replaced it today with a new phone and discovered that no backups exist in iCloud for that phone. I was counting on my ability to do a full restore from a June 2025 backup. I assumed that since I pay for the storage capacity that Apple would not groom my account without notice. HELP!

Hard to determine what happened here.

The new phone will have no backups.

If no iCloud backups were originally configured for the recovered iPhone, then none are performed.

If credentials to the recovered iPhone were compromised, then backups can be deleted.

When backups are configured and running, only the current backup is kept around and older backups are automatically replaced unless manual steps are taken.

Are you saying that when you set up your new phone, the old phone backup was not an option to be used to set up the new device? Backups are retained for 180 days if device backup is turned off. I cannot find anything in support sites saying 180 maximum for devices with backup turned on. It’s possible that the backups are only retained for 180 days.

A bit more detail…car stolen but phone was never accessed by thief…it was locked and had iCloud encryption enabled…phone sat powered off in evidence locker from 6/11/25 until I went to retrieve it yesterday and they could not produce it…got new phone today and discovered iCloud empty of iPhone files…all my laptop and iPad files are there…since my phone was powered off the entire time, I expected a backup file dated ~ 6/10/25 or 6/11/25 but nothing…can I ask/pay Apple to restore it?
