AirPods Pro 3 listening modes not working with iPhone 13 Pro

I have an Iphone 13 Pro, I just ordered the Airpods Pro 3 and none of the listening modes change anything, noise cancelling not working, transparancy or adaptive. I had the gen 1 aipods pro so i know what it's supposed to do.

I updated my iphone to latest IOS 26, I have attempted to update the airpods firmware from 8A357 but doesn't seem to work. are these not compatable with iphone 13 or something?
