I'm trying to connect my Macbook Pro to my TV, I get a display but no audio. I'm using a mini display port to HDMI

Only the latest generation of MacBook Pros supply audio over HDMI. If your MacBook Pro is an earlier model like mine, HDMI will only carry video and you'll have to connect a separate (and very inexpensive) audio cable from the audio output on your MacBook Pro to an audio input on the TV.

Is it only 15 inch that has it? I have a 13 inch or is the description wrong on the macbook pro page

All the MBP models — 13", 15" and 17" — that were released in April 2010 send audio via the Mini-DisplayPort, and with a proper MDP-HDMI adapter you should get audio to your TV fron those models via HDMI. You may have an earlier model or an adapter that doesn't support audio — many don't. Or you may not have made the necessary settings on the TV. This post may be useful:
