Warranty replacement - should I get a brand new phone or refurbished?

I have a 32GB iPhone 3GS that yesterday went completely dead. I contacted o2 who took me through steps to do a hard reset and a force restore and nothing. The phone hasn't been dropped or anything like that and is clearly still in pristine condition, even though I've had it since March. The woman on the phone suspected it's a major hardware fault with either the flash drive or the battery as there is no sign of life at all.

As this is through no fault of mine, I am going to an Apple store later today to have it replaced under warranty. However, I've been advised that replacements can sometimes be a brand new phone or sometimes a refurbished handset. I had wondered if I would end up with an iPhone 4 as I'm not sure if the 3GS is still available with the 32GB, but I know they may still have these handsets in store if they have refurbished ones.

With my situation, what's the deal with this? Since this is a fault with the phone and nothing to do with me, should I insist on a brand new replacement? Or can I even do that? It doesn't seem right that my phone fails through no fault of my own and yet I am given a refurbished handset. I could understand this being the case with someone who has been careless and smashed their screen or something but not when the phone is clearly defective. I also have insurance on the handset and am now wishing I had gone down the claim route and said I'd lost it as the insurance would just ship out a brand new phone, regardless of the situation - and even if it HAD been my fault! I really do not want a pre-owned phone, even if it looks brand new. I really wouldn't be happy with that.

I appreciate that but my main issue with having a 3GS refurb is that I suspect it will have been upgraded to the latest OS? I kept mine on OS 3 after several friends either having problems with OS 4 or just not liking it. Everyone I know with a 3GS updated to OS 4 has issues with texting - it starts out fast and then becomes excruciatingly slow and misses letters when typing. I tried it out on their handset and knew right away what they meant. That might not be an issue to some but it would be to me as I text a LOT. I get 2000 free texts a month and it's not unknown for me to go over my limit. My 3GS was really snappy with texting, never missed a letter unless it was my error. I would not want to have a phone with OS 4 installed on it.

If they will only offer a refurb, can I ask to have one with OS 3 on it instead? Or will all the refurb handsets still have OS 3 on anyway and would they leave it up to me to update it myself? Which I would obviously choose not to do.

Also, your argument about a person damaging the phone and bringing it in is invalid as the warranty does NOT cover use caused damage. If somebody was careless and broke the phone they would have to PAY for a new one or PAY for repairs. If your phone has a hardware issue and still within warranty period, then sure they will replace but as it states in warranty, can be new or refurbished and you can actually never tell which.

Some even argue a refurbished one is better than a new one. Mainly because a real person examined the entire phone as opposed to spot checks on an assembly line.

Any refurb phone in Apple's inventory would have the current iOS on it for the time it was certified. Since iOS4 has been out for over 6 months, no stock of iOS3 refurb devices would exist.

Frankly, you are basing your dislike of iOS4 on friends experience. Those friends may or may not have taken the time to diagnose and troubleshoot their problems. For all we know, the texting errors, could be the result of bad data on the phone or simply needing to reboot the device.

Try iOS4 for yourself on your own device. I personally think you will like it. I have had no problems with iOS4 on my 3GS with any feature/functionality.
