Apple don't replace battery of my iPod because It's too old?!

yesterday I want into the new Apple Store in Bologna for replace battery. Into www.apple.com at this link http://www.apple.com/support/ipod/service/prices/#italy, my iPod 40 Gb with dock connector, is a model that I can change with a payment of 59 €. Into the apple store saysthat products withmore than5 yearsnot covered by thebattery replacement, but it is notwritten anywhere. I've called at ApplceCare and they said the same thing. They have admited that it's a mistake of the web site but it's not my problem.

I'm very unhappy for this. It's not correct!
