I use SpamSeive, it uses the Spam folder, with options to mark as not spam.
I turn off all junk folder options and remove that folder.

If you have a mailbox named "Spam", it was not created by Mail. Mail uses the one named "Junk". Where is the Spam mailbox? If it is on the server (i.e., not under "On My Mac"), then it was probably created by your email provider, and is used by their spam filters.
