The blacklist is managed by the carrier, not Apple. You'll need to contact O2.

Most likely, one of two things happened. Either the phone was stolen and then sold, or the original purchaser falsely claimed it was stolen to get a replacement through insurance. These are very common scams for high end phones. Either way, the carrier will probably refuse to remove the block.

hi have contacted o2 and have also contacted orange ( my carrier ) but im getting very conflicting advise. o2 werent much help at all to be honest. just thought maybe somebody had been in the same situation they could shed some light on it for me and give me a little bit of hope that i can get my 'expensive' phone back to a phone instead of an ipod. i have also reported it to the police so thought that maybe they might be able to do something about it for me.

No one said that you stole it. But it appears that it was stolen nontheless, and anyone with stolen goods, even if purchased unknowingly and in good faith, usually has little recourse. When you buy from eBay or any other unauthorized source, there's no guarantee that the person you purchased the item from didn't steal it, and since your iPhone has indeed been reported as stolen, that seems likely that the seller did steal it, or got it from someone who did. You may well be an innocent party, but being innocent in this case doesn't get you much of anywhere. You'll need to see what PayPay will do, if anything - doubtful, but you can hope - and continue to try and work with O2, Orange and the police. You may well just be out the price of the iPhone.

Good luck; you'll need it, I fear.

Regards.

Dave is absolutely right .In Uk law you are in possession of stolen goods probably ....however

Think ,you buy a car which turns out to be stolen .The police will recover it and return it to the rightful owner

which maybe the original registered owner or an insurance company .You would have no rights whatsoever

so go lightly ,however you feel, you are out on a limb here

The old adage "Buyer Beware " was never more relevant in the age of eBay etc

i havent stolen the phone it was bought legitimately. o2 have already said its been reported stolen or lost by the account holder so im the innocent party here

I didn't say you stole the phone. You said you bought it from ebay. It was probably stolen, then sold by the thief or a fence.

You can see if PayPal will do anything for you. I don't know what the time limit is.

You may have just learned a very hard lesson. Often, buying things from ebay, especially high end electronics, is only one step above buying them from the back of a van in a parking lot when it comes to legitimacy.

thanks all so much. o2 told me that 'a person' ordered it on their account (o2 contract i presume) and they despatched it on 4/7/11, in the mean time i was 'watching' the phone for a week on ebay and then 'won' it on 6/7/11 so in theory i brought the phone before the person had even received it!! i had to email a few times to see when it was being posted......apparently it takes around 10 days from despatch from o2 for 'customer' to receive it, so really should have set alarm bells ringing. item was desribed as new, sealed and unlocked (which it was) and was an unwanted upgrade as they already had an iphone and they were happy with it. so it seems to me as though this person knew exactly what they were doing. i have reciepts and emails etc and ebay will obviously have these too and orange know exactly when it was first registered with itunes and how long warranty there is on it, but its looking like none of his actually matters!!!! cant believe someone can be so dishonest, or maybe im too naive and see too much good in people!!
