i dont no much about it but could it have been blacklisted because it hasnt been used with an o2 sim?? even though the lady on the phone said that they only put an imei bar on if its reported as lost stolen or unreceived, so maybe its nothing to do with which network it has been used on. im just hoping that there is some way of correcting it but im not feeling very confident now

Either way, it's pretty obvious what happened. The contract holder ordered a discounted iPhone as an upgrade. Either the phone was stolen from the post or off the customers doorstep, or, more likely, the customer himself reported to his carrier that he didn't receive it (so that he didn't have to pay for it), then sold it on e-bay to some unsuspecting sap (no offence intended). It can take time for iPhones to actually get 'locked down'. It may have been truly factory sealed, or it could have been opened, hacked, then re-shrinkwrapped. It really doesn't matter at this point.

The blacklist will never be lifted on it. It's stolen goods. It's too late to get anything from e-bay or pay-pal. The only thing left to do is turn it over to the police. It shouldn't be difficult for them to trace who the seller was through e-bay and pay-pal records, then you can sue them.

The same just happened to me last week. In my case it is locked with Three and it is on the blacklist. When I bought the phone it was functional but just an hour or two later it had no service. So the scumbag who sold it to me must have just reported it stolen/lost to claim insurance OR maybe it could have been newly stolen (I bought it on a sell/buy website just after 4 hours of it being posted)... of course, it depends how quick the original owner was at reporting the stolen/lost phone.

I reported it to the police and they'll do their thing (either find out if it's indeed stolen or just a insurance scam) and from the outcome I'll either return it to the original owner (if it was stolen) or deal with the scumbag that is committing fraud with the insurance to get my money back.

If the police does not find anything (nobody reported it stolen/lost) and no claims are made for the phone, then I will ask them to provide me with a letter (or something) where they indicate that the phone is now mine as it had been properly reported and no one has claimed it.

If this is possible, then I would take this letter to Three and try to get them to put the phone under my name and release it from the blacklist.

Of course it is uncertain that I will either get that support letter from the police nor that Three will be accepting that, but it's my best shot from a "legal" perspective. Otherwise, if there is no solving at all, I'll just try to get it unlocked completely.

Unfortunately it's just not as easy as that. Here's my story. I bought an LG G2 in December 2013. Six months later - June 2014 and all of a sudden I get 'No Signal' so I called up my network provider. O2. They said from a simple IMEI check that the phone had been reported as lost and stolen and to get in contact with Ebay and Paypal. However, Ebay and Paypal did not want to get involved. They claimed that it was over the 3 month (90 day) period. Ebay advised me to go to the police. I went to the police but they did not want to get involved - they said it was a civil matter and that even if the Ebay seller had sold the phone to me, he might not have been the culprit. He may have sold on a stolen phone himself from someone that sold it to him. There was no way to trace it. They just didn't want to bother. So I went back to Ebay and Paypal who again refused to get involved. The seller doesn't want the phone nor will give a refund. So I am stuck with a brick sitting on my desk and the only ones who seem the least bit bothered to help me are Barclays who have sent me a claims form with which to get my money back... hopefully. So much for the police eh?
