iPod touch, iOS 3.1.3
Was it previously using iOS higher than 3.1.3? If it's a 1st generation Touch, it cannot go higher than iOS 3.1.3 anyway.

It's a first generation but I bought an upgrade a while ago that was a 4. Something. I had it synced with my iPhone an now nothing
No - if your iPod is a 1st generation Touch, it cannot go higher than iOS 3.1.3. Simple.
If you were using iOS 4.anything, then it must be at least a 2nd gen Touch.
You really need to ensure that you have correctly identified which generation Touch you have, using the link I provided. On that page, under 2nd gen Touch is a picture of the 2nd gen and under that, a picture of the 1st gen Touch which will allow you to distinguish between the two by looking at the shape of the (black) antenna and the contour of the casing.
For your information; since the 2nd and 3rd gen Touch look similar, one way to distinguish between them is to check the number on the back of the iPod. The 2nd gen has "Model A1288" written on the back, while the 3rd gen has Model A1318 on it.
There is a clear physical difference between the 1st gen and all the later ones.
I'm not sure what you mean by "synced it with your iPhone". No idea how you do that, didn't even know that you could.
It is a 2007 ipod touch 16g first gen. i bought an update for it. i know how to read and look a shapes on a picture. At one time it was updated further than the 3.1.3.
The update to iOS 3.1.3 was a paid update. The 1G Pod can go no further.
I talked to someone and it can be fixed in stores.

... to iOS 3.0, which could then be updated (at no cost) to iOS 3.1.3

Nope.

What do you intend to fix? It is not possible to update a 1st generation Touch (which you say you have) to anything higher than iOS 3.1.3.
Really, really, really.
I believe that Illaass has said the same thing.

Ask "someone" to accompany you to the stores.
It is fixed. Leave it alone plz
There is no reason to be mean. I simply asked for help. I called the store and it was explained by someone willing to explain better then just being mean. Thank you now plz leave this alone.
No one was being mean. You were given correct answers and insisted on arguing.
Well pretty much calling me a lier and keeping on is not a way to handle it. I double checked everything that was said and called the Apple store and talked to an employee and there is a way that they can do it in stores with the hardware. No arguing was ment I just know what I am trying to say and just flat out saying nope isnt right.
No one called you a liar. They simply gave your correct answers. Period.
If someone can and will do what you want in the store, that's wonderful. You'll be the first!

No one called you a liar. You were given accurate information but chose to argue about it.

That's wonderful that they can do the impossible.
