I have the regular ipod touch. I had to restore it to factory setting which deleated all my updates as well as data. Now it will not let me update to anything higher than a 3.1.3. How doI fix this??

No - if your iPod is a 1st generation Touch, it cannot go higher than iOS 3.1.3. Simple.

If you were using iOS 4.anything, then it must be at least a 2nd gen Touch.

You really need to ensure that you have correctly identified which generation Touch you have, using the link I provided. On that page, under 2nd gen Touch is a picture of the 2nd gen and under that, a picture of the 1st gen Touch which will allow you to distinguish between the two by looking at the shape of the (black) antenna and the contour of the casing.

For your information; since the 2nd and 3rd gen Touch look similar, one way to distinguish between them is to check the number on the back of the iPod. The 2nd gen has "Model A1288" written on the back, while the 3rd gen has Model A1318 on it.

There is a clear physical difference between the 1st gen and all the later ones.

I'm not sure what you mean by "synced it with your iPhone". No idea how you do that, didn't even know that you could.

No one called you a liar. You were given accurate information but chose to argue about it.

I double checked everything that was said and called the Apple store and talked to an employee and there is a way that they can do it in stores with the hardware.

That's wonderful that they can do the impossible.
