How to check if my iPhone 4s is brand new and not a refurbished one ?

I've bought a brand new 4s and it turned out to be a defect one, now it's been sent back so that I can get a handset to handset replacement. Now am concerned that this new one which am going to receive might be a refurbished one. I need to check the device, if it is a new one or a refurbished ? How can I do that ? Please suggest ...

iPhone 4S, iOS 5

my phone was a defect piece right out of the box and I gave it back to the retailer ASAP. So now can I expect a new one instead ... ??

As woodmeister said, that would be totally up the retailer and what their return policies, if any, might be. Apple has no control over reseller return policies; for an iPhone (or any other Apple product) Apple can only go by the terms of the warranty. Apple's return polices apply only to products purchased directly from Apple.

You will need to take this issue up with your reseller if you want to pursue this further. There is nothing more we can say on the subject.

If it was returned before their return period expired and they

state they will replace with new during that period, then you

should get new. If they only state they will replace the phone,

then you could get new or refurb at their option.

YES indeed I've returned the handset as soon as I've opened the box in the showroom itself, and the sales personnel too guarenteed me that am going to get a NEW one, but they let me keep rest of the accessories and this is where I've started doubting. I mean if the intention is to give me a NEW one, they should/ve taken the entire box. And today I'd be receivng this device and still am clueless what am I suppose to do if I get a refurbished one(just in case)...

There is nothing you can do other than to argue with the store from whom you purchased the iPhone. We've said this over and over; Apple is perfectly within their rights to provide a refurbished unit. Your recourse therefore is only, let me say this again, only with the store from whom you purchased the iPhone. You willl not be able to get Apple to guarantee you a new iPhone; they will not do so.

Please stop asking. We've told you over and over again what the situation is. There's absolutely nothing more than anyone can tell you.
