To do a Reinstall of the OS boot to the Recovery HD, Command+r key at startup, then select Reinstall Mac OS X. the files will be downloaded from the internet and then the instal will begin.

With Mt Lion it is also available from the Mac App store in your Purchases area. You may be able to download it and then nmanually starting the install while booted to Mt Lion.

But I'd normally use the Recovery HD as that takes the installed OS out of the picture.

If there is older versions of Disk Utility in the Applications folder you can Delete them.

This is the first time I have heard of Disk Utility being found in the ROOT of Applications folder. They should not be there and that is why they were not overwritten by the newer version, as the one in Applications/Utility was overwritten to the newer version of DU.

Thanks Lanny. I was having trouble installing and formatting a new Hard Drive and I got the message I couldn't use Disk Utility. I started browsing this forum and found your Reply. Following your advice I went to Utilities>Applications and found a newer version. And all went all. Yes I had recently upgraded the OS. Tom

I know this is an old thread but thought I better comment as I had a similar problem with Mavericks 10.9.5.

The older version was in the utilities folder.

I usually do a fresh install on a clean or new disk.

However, I also use Apple's Migration Assistant to bring over the applications and data to the new disk where the new OSX is installed.

I had this problem today even though the Disk Utility App was in the Utilities folder.

I am going to guess it was due to using the Migration Assistant but I could be wrong.
