    They are open phones that are not new. And yes they are laying around. I can give you the name of the customer service rep who told me along with his email.

     

    Do you honestly think they have a stash of brand new devices that they just didn't feel like boxing? Let me guess, "no, they have a stash for quick returns!!"

     

    Well they must have a huge amount of phones laying around to cater to all these people returning theirs. But I'm willing to bet Apple had no idea all these people would be returning dented phones. They oversold these pre orders as it is. If you were getting a new phone, you'd be waiting weeks.

     

    You are getting a returned phone with a new faceplate that has just been sitting around.

    Seriously - why do you sound so butthurt?  Are you expecting a new box to arrive on your door with earpods and cable?  You are going to get the same as us.  My box was white, only contained a phone that looked new to me.  No scratches, chips, anything.  It was cleaner than the original I got which had fingerprints on the back aluminum.  ****, it even had the plastic protectors on the screen - just like a new phone.  No SIM card.  And the shipping labels on the box has Chinese symbols all over it.  ****, it even smelled like China... so if it didn't come from China directly, it made a stop there between CA and the East Coast.

     

    The best part was that the Apple tech went ahead and sent me two more packages (they call it a DIY replacement) which contained new EarPods and Lightning cable.  They did not have return shipping paid for, so after speaking to them on the phone they told me to just keep them.  Can't beat that if you ask me.

    You enjoy your used/repaired phone. Repaired phones will always cause issues down the road.

    You honestly don't think Apple expects to have a % of buyers send defective units in for replacement?  You do realize this is the iPhone 5, right?  Apple isn't stupid.  They plan for this.  These units are new and are on reserve for replacement through Applecare.

     

    I am wasting my time trying to explain this to you.  Isn't yours dented?  What is your plan???

    Even if the phone was possibly a repaired phone (still not possible bc they havent had time) but just to oblige your idiocy, they're still under warranty for the same amount of time, so if they have problems Apple will replace them again. It's never bad to get your phone replaced 8 months into your warranty.

    They were stupid enough to ship countless damaged phones. Enjoy your used device. Give us an update in 3 months when it starts restarting for no reason and lagging when you click the home button.

    Word of advice:

     

    DO NOT take your scuffed iPhone 5 into the Apple store hoping for a replacement, because chances are, the replacement will be scuffed.

     

    CALL APPLE and ARRANGE A REPLACEMENT. The new iPhone they send to you has been inspected by Apple Care, so they ensure the phone is flawless. This is the only way to gurantee a flawless replacement phone!

    Where have you inspected them? At the Apple Store, on the Genius Bar?

     

    When it's coming from Apple's depot and they are aware of your issue, they open as many as it takes them to find a flawless one. That's not so hard to do when you have rooms full of iPhones, they're not ALL flawed you know

    Exactly. They aren't hand picking you all new phones from the apple tree. They have an entire repair shop full of spare parts. They're fixing returned ones (there are a TON of returned ones that were sent back with OVERNIGHT SHIPPING for all you skeptics) or giving you one that never made it to the packaging line and then they're shipping it to you without thinking twice. In the business, we like to call these "refurbished" which is just plain garbage.

     

    If you broke your phone. If you dropped your phone in the pool. If you lost your phone: you deserve a refurbished phone. Apple would be losing money based on your silliness if they started giving out new phones.

     

    But for a phone that is arriving DAMAGED OUT OF THE BOX, you better demand a brand new sealed device.

     

    Idk why you guys think refurbished phones are out of the question here. I wonder how many hundreds of phones they fix in one given shift at work. Refurb phones are pure garbage. Give it 3 months before you press the home button and just sit there and wait...and wait...and wait...and oh finally it goes to the home screen! 

     

    I would demand nothing but a brand new phone seeing how that's what you paid for, but ya know, iDrones will be iDrones.

    You've yet to answer the question.  Since you seem to know it all, what is your plan to get your scratched and scuffed iPhone 5 replaced with a NEW device?  If you DEMAND Apple send you a new, unopened, sealed iPhone 5, how can  you garauntee that won't have the same damage?

    A couple of thoughts;

    -Obviously you are worked up and really concerned your replacement won't be new unless it's a box sealed.

    -There is no way that Apple has had enough time to repair and refurb damaged phones that were sent back in in 3 days to send out refurbs

    -In my case, I received it Friday and called about it on Monday. Tuesday morning I had a new one. How can you possibly fathom it's not new?

    -The purpose has been stated by others here that they obviously don't want to repeat the process by sending you another factory damages so they viusally inspect them.

     

    You've said your opinion ad nauseam here, please move on. You sound like an angry teen (your use of LOL and OMG gave you away) just forget about this and go on with your day.
