Thank You, I think it is 6+ years now w/o a cig. and the change was well worth it. And with that in mind after 20+ years of Apple Advocacy I did take a very quick look at a Youtube windows 7/8 phone demo and it looked very impressive and mature, definitely worthy of a hands on demo, plus nokia is financially desperate too make an impression and I would expect the new handsets quality too reflect that Best of Class Commintment We are a custom too from our old fruity friend, but we will see.

Hello wildtigg3r& Thank You For Posting This, I suggested to the first Apple CS rep I spoke with last Tuesday, the day after the 2000+ person riot at Foxconn, that these scratches were most likely a form of silent protest from the workers at Foxconn which She assured me was not the case. Grrrrrrr! For the record and though it is probably hypocritical for me to say as owner of Apple Gear, but for the record I am Not Pro SLAVERY! Your right on one account but also connect the dots and consider that on Sept 30, 2012 Apple began to repurchase $10 Billion in stock for future Executive acquisitions and the price of their stock coincidentally fell $11 a share on Sept 28th which was reported to cost Apple $10 Billion, just coincidence mind You. The media has been focused on Supply Constraints & maybe Map issues as the culprit for the % drop but considering the reasons behind today's labor strike and Apple's stock should continue to slide while Corporate continues to bank on the news. I'm sure Cook will address the Slavery Issues this week by conducting internal audits which will clear Apple of all wrong doing, misdirect the public and continue on business as usual unless this marks a Workers Revolution in China before the robots replace them...Just My opinion
Unexepected news from Apple. I was told that I would need to send back my phone before they would send out a replacement, however I received a shipping notification that a brand new iphone is on its way. So Apple is letting me use my old phone until the new one arrives. Great service. Will update the condition of the new phone when I receive next week. It's being shipped directly from China and looks like the same path from where I originally ordered my phone.
China Labor Watch reports (via Gizmodo) that thousands of Foxconn workers responsible for assembly of the iPhone 5 have gone on strike today, objecting to strict enforcement of increased quality control standards.
China Labor Watch (CLW) announced that at 1:00PM on October 5 (Beijing time), a strike occurred at Foxconn’s Zhengzhou factory that, according to workers, involved three to four thousand production workers. In addition to demanding that workers work during the holiday, Foxconn raised overly strict demands on product quality without providing worker training for the corresponding skills. This led to workers turning out products that did not meet standards and ultimately put a tremendous amount of pressure on workers.
According to the report, Apple and Foxconn had raised quality control standards to address issues related to scratching and other blemishes on the iPhone 5 casing, but the new standards made it extremely difficult for workers to produce phones satisfying those requirements given the equipment and training available to them.
The issues have reportedly resulted in significant tensions between production line workers and quality control supervisors, with several skirmishes having broken out in recent days resulting in injuries and damage to production facilities. In addition, Foxconn reportedly eliminated holiday vacations for workers, perhaps referring to last weekend's Moon Festival, and the company has reportedly "turned a deaf ear" to worker complaints.
Apple and Foxconn have been struggling to keep up with demand for the iPhone 5, with new online orders through Apple still being quoted 3-4 week shipping estimates. Customers have also been complaining about scratching issues, particularly on the black model, with some customers reporting that their devices have arrived scratched right out of the box.

It's likely that they just need to slow down the production output rate. They might be making them to fast to meet demand. It's a problem nonetheless, but think there's a difference.
It's unfortunate that this caused you to make the switch so quickly as I think Apple is addressing the problem. Clearly from this press release they are bringing attention to the production line.
S3 is a good phone. I have one and carry and use both iOS and Android daily. Haven't used the S3 since I got my iPhone 5 because IMHO, no comparison. My company just received 3 new black units that were flawless and Apple is sending me a new unit to replace my defective unit that was nicked. Since you have been an iPhone user since 2007, think you'll notice the difference and be able to determine which is best for you. Good luck!

Apple has never and will never address this, no matter how bad it gets. They have absolutely nothing to gain from it. Think about it, if Tim Cook were to put some apology on Apple.com, how many millions of people who have already nicked their phone on their OWN would demand a new phone, insisting that it were Apple's fault? So unfortunately, even though it IS Apple's fault in our case, we're the ones who will be taking the major butt ******* while Apple reaps all the benefits.
To me this is absolutely unacceptable and demands a boycott, but having them send us chipped after nicked after scratched phone and making them lose money sounds like a better idea.
Sorry to tell you, but somebody did a joke on you. It's NOT a iPhone 5! Look carefully:

- cheap plastic
If you have as opportunity to money back, you'd better to do it ASAP, because its not an iPhone and used it cost nothing. Even scratched iPhone is more potential.
