Apple cares about their customers more than most companies. I have seen them offer customer protection even when customers didn't deserve it. Even when a authorized reseller won't help you, they will. Per their website:

If the authorized reseller won't accept the Apple product return, Apple will accept the return under the following circumstances:

You purchased the Apple product from an Apple authorized reseller in the United States. The reseller refused to accept the Apple product return.
The proof of purchase includes the reseller name and address, product and version purchased, purchase date, and purchase price.

As for why they decided to keep the iPad 2 instead of replacing it with the iPad 3 I have no idea. It makes no sense. When the iPad 3 came out it did make sense to sell the iPad 2 cheaper, but now that the iPad 4 has been introduced why keep the iPad 2 in their lineup? you would think they would remove the iPad2 and replace it with the iPad 3. As for why they came out with the iPad 4 so soon, that is easy to figure out. The marketplace has been flooded this past year with iPad wannabes. Even MS is coming out with one. The holiday season is just ahead and Apple needs to put their BEST foot forward to have a strong showing this holiday season. The upgraded iPad 4 does just that. It’s a world class tablet, and now if anyone wants to buy a high end tablet this christmas shopping season, they need look no further than the Apple iPad 4. It’s not that they brought the iPad 4 out too soon, it’s more that they released the iPad 3 too late. I had a iPad 3 and it worked GREAT! Yes, even the Wi-Fi worked flawlessly. iOS 6 worked flawlessly too. However I sold it because I knew that the resale would drop as soon as they released the iPad mini (which I’ll be buying very soon).
My friend also has a iPad 3, his works flawlessly too, and he also has iOS 6 installed. For those that have a iPad 3 and wish they had a iPad 4, just sell your iPad 3. iPads have the best resale value of ANY tablet on the market. There are plenty of people out there more than willing to buy it. For those that say they are going to buy a different brand of tablet, you better think twice. No other tablet in the world offers as good of a tablet experience than the iPad does. I’ve had nooks, androids, kindles, ect. and NONE of them was comparible to the iPad, and one big reason is because only iPads have access to iOS apps. Tablets all use the same resistors, capacitors and transistors, it’s the apps that matter most, and iPads have the best app developers in the world. If I just bought a iPad 3 (but it has been over 14 days) I would just sell it. Really, the sooner you do, the quicker it will sell. I know you don’t want to hear this but spinning your wheels here and whining isn’t going to help you. There are still people who don’t know about the iPad 4, and the longer you wait to sell your iPad 3 the harder it will be. Best of luck with whatever you decide.
