Eligibility for an out of warranty replacement is always at Apple's discretion, but their price for a replacement is roughly half that of a new one. The replacement will be refurbished, not new.

It will be replaced wit an almost brand new phone. Since there are 2 devices created at a time. one is sold with accessories and one is for replacement.

They don't use new iPhones as replacements unless they do not have any refurbs in stock. Doesn't happen much at all.
Well yes, if its already Out of warranty. If it's still in warranty and the issue that you have is just something on the parts of the phone and its not an accidental damage/water damage it will be covered.
It's still not a refurbished one. since its an identical device as with the one the customer have. You may try to call Apple and check with them. The replacement went under Quality control and came out straight of the factory.
