I got a notification saying that I can update my iPhone 4S to iOS 7 went to update just before and it is saying that phone is up to date with iOS 6.1.3 and that I can't update - what's going on?
What version of iTunes is on the computer?
Updating to iOS7 requires iTunes 11.1 which was just released today.

The notification was on my iPhone in the settings section. In the past when an update was available it has notified me there, it has since disappeared from there.

Try updating via itunes 11.1
