Yes, it works, but it's not Activation Lock, the original subject of this thread. If the device is asking for a four or six digit numerical code, this is a passcode, and as you say can be got past by erasing and resetting the device. If however the device is showing a screen like that shown at right, this is Activation Lock and without the required ID and password being supplied by the person who set the lock there is no way whatever of bypassing it. That was the situation the OP found himself in.
Apple has absolutely no obligation to "fix" this. The owner of the device placed a lock on it. The lock is doing EXACTLY what it is intended to. It is preventing an unauthorized party from activating and using the device.
Gamestop, and other places that sell second hand phones, need to pull their heads out of their collective bungholes and check to make sure the phones they purchase are not locked before they sell them.
Buyers need to check to make sure that phones they purchase second hand are not locked before they buy them.
Apple can and will remove and erroneous lock for someone who can prove ownership of the device using an original proof of purchase for the phone. Beyond that, it's not their problem.
It doesn't necessarily mean it was stolen. It could very well be that the owner (as stupid as it is) sold it because they forgot the stupid password and info to retrieve it. Been there done that before...

Purposely selling a locked phone is exactly the problem. All you are doing is taking your problem and making it someone else's. There are ways to work with Apple to retrieve your Apple ID and password, thus providing you the option to place the device in the correct appearance to be sold. Selling it knowingly as locked is just exacerbating the problem!

Just to add to this, it could be easily argued that purposely selling a locked phone without disclosing that the phone is completely useless as anything other than a paperweight, constitutes fraud.

I feel sorry for the poor OP that instead of getting treated with respect, he or she gets treated in a very rude manner and also accused of buying a stolen phone.
As for this icloud lock system, I personally think that it's a stupid idea and even though I own a iPad myself, I would never own a iPhone myself just because of this stupid security system which inconveniences both the owner and the person who buys a pre-owned iPhone.
I also sincerely hope that the OP can get the phone unlocked if only to prove the unhelpful people here wrong...

The use of it is optional. No one has forced anyone to activate it. Its just like locking the doors on your car. The lock is there for you to use. If you wish not to lock your car as an anti-theft measure then that's up to you.
I know the use of it is optional, but I'm just frustrated at how a lot of people in this thread were really rude towards the poor OP just because they dared to ask how they could unlock a legitimately bought iPhone.
I own a Galaxy S4 myself and I use a pin lock plus Prey as well plus I do a backup as well.

The feature is on iPads also. And soon it will be on every smartphone sold in the United States, and probably the rest of the world. I am THRILLED that the person who steals my phone will be inconvenienced, and THRILLED that anyone who buys a stolen phone will be inconvenienced and unable to use it. Word is getting out that stealing iPhones and buying iPhones from dubious sources is counterproductive. There was an article recently reporting that thefts of iPhones have diminished substantially, and thefts of Android phones that don't have this feature are way up. That makes me very happy, although I am sorry for the luckless Android phone users whose phones have been stolen.
So you're basically saying that people who genuinely forget their iCloud login details or who buy a legitimate iCloud locked iPhone should be punished by having their iDevice turn into a paperweight just because the previous owner was either forgetful or too lazy to give the buyer the login details...
I just thank God that I live in the UK as this sort of rubbish would probably be banned here and in the rest of Europe thanks to the EU being against stuff like this.
Im also proud of and am grateful that I own a Android phone and will always own one!
Don't be so smug. It works the same way in the UK, and the police there are thrilled also. As you will see if you bother reading other posts on the subject.
The user forgetting their ID or passcode is a red herring and nonissue. Apple provides help for people in this situation, both automated and live help.
