A hard reset on my iPhone did the trick along with disabling iCloud. The Photos App is an absolute crap shoot. Who wants to bet money after reenabling the Photo Library it will soon tell me there's 500 brand new photos to import.
To anyone read this and want a SOLUTION regarding the delete button not appearing... I am using OS X Yosemite and just discovered you will need to do this in this exact order.
Select Settings then iCloud and proceed to Photos. TURN OFF EVERYTHING IN THE PHOTO SECTION. Exit out and restart Image Capture on the Mac. The delete button should now be there. I hope this helps!!!
This DOES NOT WORK.
There seems to be no way to delete photos on the phone using Image Capture. This of course makes any photo-workflow very difficult.
Thanks Apple. iOS 8 is the worst yet.
To delete you must not hit just the "delete" key it must be "command+Delete". hope that solves your problem.

Thank you so much - this has been driving me nuts.
So then afterwards, just reset the iCloudPhotoLibrary button.

Hello! Could you please provide a screenshot?
From my experience, you have to wait until all image thumbnails are loaded into the selection grid, then the Delete after Import appears.
Turn off iCloud Photo Stream on the device.
THIS is very helpful! Thank you very much!!
Agree with you WestVanPete. The answer given above DOES NOT WORK.
I turned off iCloud Photo Stream and the "Delete" button is still missing.
The suggestion was to turn off iCloud Photo Library, not Photo Stream.
