Forgot to back up old ipad and lost all photos from it, can i get them back?

I sold my old ipad and did not back it up to icloud as I was under the impression it would back up automatically. When I bought my new ipad a month ago I had no file to backup from so now I've lost all my old photos. Is there any way to retrieve them? Could Apple retrieve them if I called.?
