now it says that the update is not available in the us stores. What can i do?

I just bought a new mac book pro and it updated to Photos which *****!! I want I photo back!! I read some other questions that this was possible so I am hoping someone can help. I got the app back from Time machine but now it is saying the update for i photo is not available in the us stores. Is there a way i can get this back?
