If you didn't download and install it when it was available in the app store you won't have that option. You will only see yosemite as a possible upgrade. If you or a friend had it on another mac you can download the installer and transfer to your mac.

Do not install a copy of Mavericks from a friend, or anyone else. In order to install, or reinstall it, you have to know the user ID and password of that person's App Store account. And no one in their right mind would give you that information since you could then purchase all kinds of software on their credit card. Or worse (for the crooks who do this kind of thing), immediately go into the account and change the password to lock the legitimate user out of their own App Store account.

If you didn't get it from Apple while it was available, you're just plain out of luck.

Installing from a torrent is absolutely the worst choice you could make. There's no way of knowing what other software has been added to the installer package. Illegal software is how most malware gets installed on Macs. Such as back doors, keyloggers, etc. Never, ever install software obtained from torrents, P2P, or other sources of illegal software.

Just to clarify i didn't mean for anyone to give him their info. No one should do that. But for an example - i did download Mavericks and it appears in my purchase section of the App store as does Lion/ML. I can download it at any time. After the installer is in my applications folder i can copy it to a pen drive or save it to a hard drive. That way i don't have to go and download it again if i need to reinstall mavericks. I could use that copy to create a usb installer and then install mavericks on any mac. Since it was a free upgrade i don't see any software violations issues.

It still is. The download is tied to your account. You can of course, as you noted, install it as many times as you want since you can always retrieve it from your App Store account. But the license only allows you to install it on Macs you own. It's not all you can share.

(1) to download, install, use and run for personal, non-commercial use, one (1) copy of

the Apple Software directly on each Apple-branded computer running OS X Mountain

Lion, OS X Lion or OS X Snow Leopard (“Mac Computer”) that you own or control;

If someone were to install Mavericks on another Mac, and that person ever has to reinstall it, they won't be able to without the ID and password of an App Store account Mavericks was "purchased" under.
