Apple does take ownership if there is an iOS flaw. If there are issues with a device, even when working at the time, iOS updates can cause the issue to come to the surface, as well as things where the device cannot handle the update. I cannot talk about anything else Apple might or might not do, as it is prohibited by TOS, and I don't work for Apple.

So Apple refused to service your device for this error?

The 1970 issue, Apple has addressed and released a support document saying they are working on an update to prevent this from happening in the future. Taking the device to Apple and they will fix for free.

The best advise is to say what you know, what you can prove by doing yourself, or what is provided in Apple support documents. Error 53 is reported as a hardware error, and users can deal with Apple on that.
