That is the original iPad Mini, not the Mini 3. You cannot update to iOS 10. These can be updated to iOS 10.
What happens when you try to update? Any error messages?
Are you using iTunes or WiFi? Which ever way you are trying, use the other method and see if it will update that way, though it should work either way.
I've tried wifi, cell and Itunes...each time is says 9.3.5 is the latest version. I even signed up for beta and created the beta profile...tried deleting and recreating the profile 3 times with no IOS beta software download becoming available.

That model is actually a first generation iPad Mini, which can not be upgraded further.
That is because 9.3.5 IS the latest version for that model.
Did you read the two posts above by stedman and me? You have the original iPad Mini. You do not have the mini 3. You cannot update it beyond iOS 9.3.5.
