Is it illegal to buy a stolen iPhone?

I don't mean any iCloud locked iPhones, but there are iPhones on eBay that can sell you for very cheap and it is in new condition. If its an iPhone 7, I bought it for $250 new, is it considered stolen, and will I get arrested for buying a stolen iPhone or iCloud locked one? There are some stolen iPhones that can be usable. If the iPhone is stolen from the Apple Store, will it work, or does it need to be activated? I heard stories about people buying iPhones that were stolen.
